MyPet – Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the MyPet mobile application, the mypetcollars.com website, and the MyPet smart collar and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1. Who We Are
The Services are provided by Mypet Yazılım Teknolojileri A.Ş. ("MyPet", "we", "us").

2. Eligibility & Accounts
● You must be legally capable of entering into a binding contract (e.g., be at least the age of majority in your jurisdiction) to use the Services.
● When you create an account, you agree to provide accurate, current, and complete information and to keep it updated.
● You are responsible for any activity that occurs under your account and for safeguarding your login credentials. Notify us promptly of any unauthorized use.
3. License to Use the Services
Subject to these Terms, MyPet grants you a limited, non-exclusive, non-transferable, revocable license to install and use one copy of the MyPet app per device solely for your personal, non-commercial use.
You may not:
● Modify, copy, adapt, translate, or create derivative works of the app or any content therein;
● Use the Services for any commercial purpose without our prior written consent or for any public display;
● Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software, except to the extent such restrictions are prohibited by law;
● Remove or alter any copyright, trademark, or other proprietary notices;
● Circumvent or interfere with any security or access-control features of the Services.
All rights not expressly granted are reserved by MyPet and its licensors. The Services and all content, features, and functionality (including software, text, graphics, logos, and trademarks) are owned by MyPet or its licensors and are protected by intellectual property laws.
4. User Responsibilities & Acceptable Use
You agree to:
● Use the Services in compliance with applicable laws and these Terms;
● Provide accurate information about your pets and keep it up to date;
● Respect the rights, privacy, and safety of others;
● Report inappropriate content or behavior to us.
You agree not to:
● Upload or share content that is unlawful, misleading, defamatory, obscene, or infringes any third-party rights;
● Harass, bully, or harm others;
● Attempt to gain unauthorized access to the Services, accounts, or systems;
● Use any robot, spider, scraper, or other automated means to access the Services;
● Probe, scan, or test the vulnerability of any system or network without authorization;
● Interfere with or disrupt the integrity or performance of the Services.
We may, but have no obligation to, monitor or remove content or accounts that violate these Terms.
5. Pet Care & Veterinary Disclaimer
Content and features in the Services (including activity insights, wellness tips, or notifications) are provided for general informational purposes only. The Services are not a medical or veterinary device, and do not provide medical diagnosis or treatment. Always consult a qualified veterinarian for any health concerns regarding your pet. Never disregard professional advice or delay seeking it because of something you read in the Services.
6. Smart Collar, Location, and Safety Notices
● Location & Accuracy. GPS and network location may be inaccurate, unavailable, delayed, or dependent on third-party services (e.g., maps, connectivity). Do not rely solely on the Services for pet safety or theft/loss prevention.
● Geofencing. Alerts (e.g., leaving a safe zone) may be delayed or missed due to coverage or device limitations. Geofencing is a convenience feature only.
● Battery & Maintenance. Battery life varies with usage, environment, and settings. Keep firmware updated and inspect the collar regularly. Do not use damaged equipment. Follow all device care and charging instructions.
● Responsible Use. The Services are not a substitute for responsible pet ownership or supervision, and are not intended for emergency use.
7. In‑App Purchases, Subscriptions & Trials (if applicable)
● Subscriptions. Certain features may require a paid subscription. Subscription terms, pricing, and renewal details are disclosed at purchase. Unless otherwise stated, subscriptions auto‑renew until canceled.
● Billing & Taxes. You authorize us or our payment processor to charge the applicable fees and taxes to your selected payment method. You are responsible for maintaining valid payment information.
● Trials. If you start a free trial, you will be charged at the end of the trial period unless you cancel before it ends.
● Cancellation. You can cancel at any time via your account settings or the app store (Apple App Store / Google Play). Cancellations take effect at the end of the current billing period.
● Refunds. Refund eligibility is governed by these Terms and/or the app store's policies and applicable law.
8. Third‑Party Services & Links
The Services may include links to or integrations with third‑party websites, apps, or services (such as maps, analytics, payments, or sign‑in providers). We do not control and are not responsible for third‑party content, policies, or practices. Your use of third‑party services is subject to their terms and privacy policies.
9. Content You Provide; Feedback
● User Content. You retain ownership of any content you submit to the Services. You grant MyPet a worldwide, non‑exclusive, royalty‑free license to host, store, process, display, and use your content solely to provide and improve the Services.
● Feedback. If you provide ideas, suggestions, or feedback, you grant MyPet a perpetual, irrevocable, worldwide, royalty‑free license to use them without restriction or compensation.
10. Changes to the Services
We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice, including by adding or removing features. We are not liable for any modification, suspension, or discontinuation.
11. Software Updates
The app may automatically download and install updates or enable you to install them. Some updates may be required to continue using the Services.
12. Apple App Store & Google Play Terms
If you downloaded the app from the Apple App Store or Google Play, their terms also apply. For Apple users: Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support. To the maximum extent permitted by law, Apple has no warranty obligation and no liability for claims relating to the app. You acknowledge Apple and Apple's subsidiaries are third‑party beneficiaries of these Terms.
13. Disclaimers
To the maximum extent permitted by law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the Services will be uninterrupted, error‑free, secure, or free of harmful components, or that any data (including location) will be accurate or available at all times.
14. Limitation of Liability
To the maximum extent permitted by law, MyPet and its affiliates, officers, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the Services, even if we have been advised of the possibility of such damages. To the extent permitted by law, our aggregate liability for all claims relating to the Services in any 12‑month period is limited to the greater of (a) the amount you paid to MyPet for the Services in that period.
Some jurisdictions do not allow certain limitations or exclusions; in such cases, the above limitations apply to the fullest extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless MyPet and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
16. Termination
We may suspend or terminate your access to the Services at any time if we reasonably believe you have violated these Terms or applicable law, or if required by law or by third‑party partners. You may stop using the Services at any time. Upon termination, the rights granted to you under these Terms will end. Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitations of liability, indemnification) will survive termination.
17. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of KOCAELİ MAHKEMELERİ without regard to conflict‑of‑laws rules. You submit to the exclusive jurisdiction and venue of the courts located in KOCAELİ / TURKEY to resolve any dispute arising out of or relating to these Terms or the Services.
18. Export & Sanctions Compliance
You agree to comply with all applicable export control and economic sanctions laws. You represent that you are not located in, or a resident of, any country or region subject to comprehensive sanctions and are not a prohibited party under applicable laws.
19. Electronic Communications; Notices
By using the Services, you consent to receive communications from us electronically (e.g., email, in‑app messages). We may provide notices by posting within the Services or by emailing the address associated with your account. You are responsible for keeping your contact information current.
20. Miscellaneous
● Entire Agreement. These Terms constitute the entire agreement between you and MyPet regarding the Services and supersede any prior agreements.
● Severability. If any provision is held invalid, the remaining provisions will remain in full force and effect.
● No Waiver. Our failure to enforce any provision is not a waiver of our rights.
● Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
● Force Majeure. We are not liable for delays or failures due to events beyond our reasonable control (e.g., natural disasters, outages, war, acts of government).
